DHS Announces Major Changes to F-1, J-1, and I Visa Admission Rules
The Department of Homeland Security (DHS) has published a final rule that changes how individuals in F (academic students), J (exchange visitors), and I (foreign media representatives) are admitted to the United States.
For many years, these nonimmigrants were admitted under “Duration of Status (D/S),” allowing them to remain in the United States as long as they maintained their immigration status.
Under the new rule, DHS is replacing “Duration of Status” with a fixed admission period. Instead of remaining in the U.S. for an open-ended period tied to their program, eligible individuals will generally receive an admission period with a specific expiration date.
If they need to remain in the United States beyond that period, they may need to apply for an extension of stay with USCIS or otherwise maintain lawful status.
What This Means
Applicants should begin paying closer attention to the expiration date listed on their Form I-94 rather than relying solely on their educational program dates.
This change may affect:
- F-1 academic students
- J-1 exchange visitors
- I visa holders
- Certain dependents in these classifications
The rule is scheduled to take effect September 15, 2026, subject to congressional review.
